California Civil Code section 1793.2 addresses a manufacturer’s duty when a vehicle cannot be conformed to the applicable express warranties after a reasonable number of attempts. The analysis is fact-specific. A safety recall, service bulletin, software update, or parts replacement may be useful evidence, but none alone decides the claim.
Describe the symptom—not only your diagnosis. If the vehicle stalls, loses propulsion, will not charge, shakes, leaks, or displays a warning, ask the dealer to write that condition accurately on the repair order.
There is no universal number for every claim. The seriousness of the condition, the number of attempts, cumulative days out of service, timing, warranty coverage, and repair history all matter.
Repeated presentation of the same substantial condition can be important, but related symptoms, unsuccessful repairs, parts delays, and extended downtime may also matter. A legal review should consider the complete chronology.
Keep the repair order. Intermittent conditions can still be documented through videos, photographs, warning messages, witness information, and repeated service visits.
